828 Boxing — Terms and Conditions of Membership

1. Agreement to Terms
By applying for or renewing membership at 828 Boxing, you agree to these Terms and Conditions, our Privacy Policy, and any rules or safety guidelines displayed on-site or on our website.
Please read them carefully before joining.
2. Membership and Fees
Eligibility: Membership is open to individuals aged 8 years and over. Members under 18 must have a parent or guardian complete the Liability Waiver Form.
Fees: Membership fees are payable in advance — weekly, fortnightly, or monthly — depending on your chosen plan.
Payments: All payments are managed through our secure payment provider. By joining, you authorise 828 Boxing to deduct fees automatically until you cancel your membership in accordance with these Terms.
Late or missed payments: 828 Boxing reserves the right to suspend access or cancel membership if payments are missed.
Changes to fees: 828 Boxing may review membership fees with at least 30 days’ written notice to members. Members who do not agree with a fee change may cancel within that notice period.
Age Group and Session Accuracy: When signing up with 828 Boxing, please make sure the session or group you’ve chosen matches the correct age category. Each session is priced according to age, so it’s important that members are registered in the right group.
Member Information Accuracy: Members agree that all information provided to 828 Boxing — including personal details, contact information, health declarations, and age verification — is true and correct to the best of their knowledge. Members must promptly update 828 Boxing if any details change.
Providing false or misleading information may result in suspension or cancellation of membership.
If a member is found to be enrolled in an incorrect group, 828 Boxing has the right to update the membership type and fee to reflect the correct category. Any difference in payment will need to be settled before continuing with sessions.
3. Cancellations and Refunds
Ongoing memberships: You can cancel at any time by giving 7 days’ written notice or approved verbally with one of the authorised staff.
Minimum Payment Term: Upon registration, members agree to a minimum commitment of four (4) scheduled payments. Should you choose to cancel your membership prior to completing these payments, you will remain liable for the outstanding balance of the minimum payment term.
Cancellations by 828 Boxing: 828 Boxing may cancel any membership if a member breaches these Terms, engages in unsafe or inappropriate conduct, or fails to pay fees as required.
Refunds: Refunds are only provided where required under the Consumer Guarantees Act 1993 or if 828 Boxing is unable to deliver the agreed services with reasonable care and skill.
4. Health and Safety
You confirm that you are in good physical condition and have no medical condition that would make boxing or training unsafe for you or others.
You agree to follow all health, safety, and hygiene instructions provided by coaches and staff.
You must immediately report any injury, incident, or unsafe condition to a staff member.
While 828 Boxing takes all reasonable steps to provide a safe environment, participation in physical activity carries inherent risk. You accept responsibility for your own safety to the extent permitted by law.
828 Boxing is not liable for injury, loss, or damage arising from participation unless caused by 828 Boxing’s negligence.
5. Code of Conduct
All members must:

Treat staff, coaches, and other members with respect.

Follow reasonable directions from 828 Boxing staff and trainers.

Not engage in harassment, discrimination, or aggressive behaviour.

Use equipment safely and return it to its proper place after use.

Maintain good personal hygiene and wear appropriate attire.
Breaching this code may result in suspension or termination of membership.
6. Service Standards
828 Boxing will provide classes, coaching, and facilities with reasonable care and skill, as required under the Consumer Guarantees Act 1993.
If 828 Boxing fails to meet these standards, members are entitled to request an appropriate remedy such as rescheduling, a credit, or refund, depending on the circumstances.
7. Personal Property
828 Boxing is not responsible for loss, theft, or damage to personal items brought into the premises unless caused by 828 Boxing’s negligence.
8. Privacy and Personal Information
828 Boxing collects personal information to manage memberships, payments, and ensure safety.
We comply with the Privacy Act 2020. You may request access to or correction of your personal information at any time by contacting us at [insert email address].
Your information will not be shared with third parties except as required by law or for legitimate operational purposes (e.g. secure payment processing).
9. Changes to Terms
828 Boxing may update these Terms occasionally to reflect operational or legal changes. Members will be notified in writing (by email or notice on premises) at least 14 days before any significant change takes effect.
If a member does not agree to a material change, they may cancel their membership within that notice period without penalty.
10. Complaints and Disputes
We encourage members to raise any concerns directly with the authorised staff either in-person or by email.
If an issue cannot be resolved informally, it may be referred to the New Zealand Disputes Tribunal or the Courts, as appropriate.
11. Governing Law
These Terms are governed by the laws of New Zealand.
If any part of these Terms is found to be invalid or unenforceable, the remainder will continue in full effect.
